Is it worth spending money on a lawyer at all?
Yes. If you can avoid a hopeless process through legal advice, the advantage is obvious. If you win a process with legal assistance, the opposing party is usually obliged to reimburse the costs. Those who have legal protection insurance enjoy this cost protection. Anyone who wants to conclude an important contract should also seek advice from a lawyer. This saves costs and hassles and gives the security of a balanced result.

Are legal fees regulated by law?

Yes. The legal basis for fees in Germany is the Lawyers’ Fees Act (RVG). It differentiates between fixed fees and frame fees. Fixed fees mostly apply to legal activities in civil, administrative and labor law. The law provides framework fees mainly for extrajudicial activities and for the areas of social and criminal law.

The fees for advice and for the provision of legal opinions are subject to the agreement between the lawyer and the client. In individual cases we will make specific suggestions for you.

How much do judicial matters cost?

Here the lawyer’s fee is calculated from two factors: the value of the item and the activity carried out according to the order.

The object value of a matter is understood as the objective monetary value or the economic interest of the client. In the case of claims, it corresponds to the amount of the claim made or to be defended. In the case of matters not related to property law, the value of the item can be found partly in the special statutory provisions and partly in the extensive case law. In judicial proceedings, the value of the item is determined by the court.

What do you actually calculate?

That depends on the scope and difficulty of the matter. For a quick oral advice rarely more than 10, – € to 50, – € will arise, for a written elaboration it can be several 100, – € in individual cases. In any case, we will be happy to tell you the costs before starting our work.

For out-of-court correspondence there is usually a 1.3 business fee according to No. 2300 VV RVG from the item value. If it is possible to reach an out-of-court settlement, a settlement fee of 1.5 in accordance with No. 1000 VV RVG is added to the item value.

The legal activity generally incurs a 1.3 procedural fee, a 1.2 appointment fee for attending appointments in court and, in the event of an agreement, a 1.0 agreement fee. The fees arise from the item value, which the court determines.
